The Recruitment Junction – ACAS Early Conciliation Refusal and Timeline

Phoenix Wright delivers his trademark "Objection!" in the courtroom.

Case: Kieron JH v The Recruitment Junction

Introduction

This update explains what happened between The Recruitment Junction and the ACAS Early Conciliation process, why a certificate was issued, and how the timeline supports public accountability. Readers looking for background on Beverley Brooks and The Recruitment Junction can also see our earlier profile of the charity’s leadership and governance.

Key outcome in one paragraph

ACAS has issued an Early Conciliation Certificate for Kieron JH v The Recruitment Junction after The Recruitment Junction declined to engage with Early Conciliation. The certificate confirms that the legal requirement to contact ACAS was met and that conciliation could not proceed because the respondent did not participate. Tribunal time limits now resume, and the claim can move ahead.

Timeline

August 2025 – Pre-action and Subject Access Requests

  • 28 August 2025 – A formal Pre-Action Protocol Letter was served on The Recruitment Junction. It set out factual background and legal grounds under the Equality Act, Data Protection Act, harassment, and defamation. It enclosed an Exhibit that summarised the pattern of failures, a Schedule of Loss totalling £48,750, and a reasonable settlement proposal.
  • 28 August 2025 – A refreshed Subject Access Request was submitted requesting internal emails, meeting notes where the claimant is referenced, and related records. The statutory deadline for a response was 28 September 2025.

September 2025 – Silence and suspected email blocking

  • Multiple follow-ups were sent. After suspected silent blocking, correspondence was re-submitted to senior staff and trustees to ensure fair notice and preservation of data.
  • 24 September 2025 – An article was published examining public records and governance questions concerning Beverley Brooks and The Recruitment Junction. The organisation was invited to provide factual corrections or clarifications. No response was received.
  • The statutory Subject Access Request deadline passed without disclosure or acknowledgment.

ACAS Early Conciliation – 31 August to 8 October 2025

  • 31 August 2025 – ACAS was notified of the intended Employment Tribunal claim against The Recruitment Junction, in line with legal requirements.
  • Throughout September and early October, ACAS requested materials. The conciliator received the pre-action documents, the £48,750 Schedule of Loss, and a settlement proposal of £30,000 plus non-financial remedies with scope to negotiate.
  • 8 October 2025 – ACAS confirmed that The Recruitment Junction did not wish to engage with Early Conciliation. A certificate was issued and the conciliation process formally closed.

What the ACAS certificate means

The certificate confirms that the claimant followed the law by contacting ACAS before lodging a tribunal claim. It also records that conciliation did not take place because The Recruitment Junction declined to participate. The time-limit clock resumes, so a tribunal claim can now be issued. In practical terms, it shows the claimant sought a fair and efficient resolution through ACAS and that the respondent chose not to use that channel.

Why this matters for The Recruitment Junction and Beverley Brooks

The Recruitment Junction had multiple opportunities to address concerns through written correspondence, Subject Access Requests, and an independent conciliation service. The refusal to engage sits alongside wider governance concerns already documented.
