Disability Confident Employer Status Confirmed in Ongoing Case | The Reasonable Adjustment

Case Update: Disability Confident Status Confirmed

We have received confirmation from the Department for Work and Pensions (DWP) that the charity involved in our ongoing case is registered as a Disability Confident employer.

This update is relevant due to the nature of the concerns raised, which include:

  • Failure to provide reasonable adjustments under the Equality Act 2010
  • Service withdrawal following a disagreement about CV formatting
  • Blocked communication channels following lawful rights-based requests
  • Potential issues related to data protection and GDPR compliance

The Disability Confident scheme is a voluntary, business-led initiative designed to help employers recruit, retain, and develop disabled people. Organisations participating in the scheme make specific commitments around inclusive practice, and are expected to uphold those commitments in their day-to-day operations.

According to the DWP’s guidance, the scheme itself does not provide an enforcement mechanism. Individuals raising concerns are expected to go through the employer’s internal complaints process first. If the matter remains unresolved, external organisations such as ACAS or the Equality Advisory and Support Service (EASS) may be contacted for further support.

This update raises further questions about the alignment between public commitments made under the Disability Confident scheme and the experiences of disabled individuals in practice. We will continue to monitor developments and publish further information as it becomes available.
